Welcome to SocialSpikes ("Platform", "we", "our", or "us"). By accessing or using our website, mobile application, or services, you agree to comply with these Terms & Conditions. If you do not agree with these Terms, please discontinue using our Platform.

1. Eligibility

To use SocialSpikes, you must:

• Be at least 18 years of age or have permission from your parent or legal guardian.
• Provide accurate, complete, and current registration information.
• Own and control the social media accounts linked to your profile.
• Comply with all applicable laws and regulations.

2. User Account

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

• Keep your password secure.
• Use only one account unless specifically authorized.
• Keep your profile information up to date.
• Notify us immediately if you suspect unauthorized access.

You must not:

• Create fake or duplicate accounts.
• Impersonate another individual or organization.
• Share or sell your account.

Violation of these rules may result in permanent account suspension.

3. Platform Services

SocialSpikes is a digital marketplace connecting advertisers with creators and influencers.

Our Platform allows users to:

• Purchase promotional campaigns.
• Promote social media content.
• Complete engagement tasks.
• Earn rewards and cash.
• Redeem SP Points.
• Withdraw verified earnings.

SocialSpikes acts solely as a technology platform and is not responsible for agreements made outside the Platform.

4. Wallet System

SocialSpikes maintains three separate wallets.

A. Credit Wallet

The Credit Wallet is used for:

• Adding funds through approved payment gateways.
• Purchasing campaigns.
• Buying promotional services.

Important

• Credit Wallet funds cannot be withdrawn as cash.
• Wallet balances are non-transferable.
• Promotional credits may have an expiry date.

B. Earnings Wallet

Cash rewards earned from verified campaign activities are credited to your Earnings Wallet.

Earnings become eligible for withdrawal only after:

• Successful verification
• Fraud review
• Compliance checks
• KYC approval

C. SP Points

SP Points are promotional reward points.

SP Points:

• Have no direct cash value.
• Cannot be transferred.
• Cannot be exchanged unless specifically allowed.
• May expire according to promotional rules.

5. Campaign Rules

Advertisers are responsible for ensuring that all submitted content:

• Is accurate.
• Does not violate any law.
• Does not infringe copyrights or trademarks.
• Does not contain misleading or prohibited content.

SocialSpikes reserves the right to reject, pause, edit, or remove any campaign at its sole discretion.

6. Creator Responsibilities

Creators agree to:

• Complete only genuine engagements.
• Use their own authentic social media accounts.
• Follow campaign instructions.
• Maintain honest and natural interactions.

Strictly Prohibited

• Fake Likes
• Fake Shares
• Fake Comments
• Purchased Followers
• Click Farms
• Automated Bots
• Scripts
• VPN Abuse
• Artificial Engagement

Violation may result in immediate suspension and cancellation of earnings.

7. Verification & Rewards

All campaign activities are subject to verification.

Rewards are credited only after successful verification.

Rewards may be cancelled if:

• Tasks are incomplete.
• Required proof is missing.
• Fraudulent behaviour is detected.
• Campaign rules are violated.
• Social media actions are removed before the required verification period.

SocialSpikes reserves the right to make the final decision regarding reward eligibility.

8. Withdrawals

Users may request withdrawals from their Earnings Wallet after successfully completing the required verification process.

Required Verification (KYC)

Before processing any withdrawal request, SocialSpikes may require:

• ✅ PAN Card
• ✅ Bank Account Verification
• ✅ UPI ID Verification
• ✅ Government-issued Identity Proof
• ✅ Additional KYC documents where required

Withdrawal Conditions

• Minimum withdrawal amount must be met.
• Withdrawal requests are subject to manual or automated review.
• Processing time may take 1–7 business days.
• Withdrawals may be delayed during holidays or banking interruptions.
• Withdrawals may be rejected if fraudulent activity is detected.

9. Payments & Refunds

Payments are processed through authorized payment gateways.

Refund Policy

• Campaign purchases are generally non-refundable once activated.
• Approved refunds will normally be credited back to the Credit Wallet.
• Payment gateway charges and taxes are non-refundable.
• Refund requests are reviewed individually.

Failed or Duplicate Payments

If you experience:

• Failed payments
• Duplicate charges
• Wallet credit issues

Please contact our support team with your transaction details.

10. Prohibited Activities

The following activities are strictly prohibited:

• Creating fake or duplicate accounts.
• Using automation tools or bots.
• Manipulating engagement metrics.
• Buying or selling fake followers.
• Uploading copyrighted content without permission.
• Posting illegal or offensive content.
• Spamming users.
• Misusing referral programs.
• Attempting unauthorized access.
• Reverse engineering the Platform.
• Disrupting Platform operations.

Consequences of Violations

SocialSpikes may, without prior notice:

• Suspend your account.
• Permanently terminate your account.
• Freeze wallet balances.
• Cancel earnings.
• Reject withdrawals.
• Remove campaigns.
• Recover fraudulent payments.
• Report illegal activity to law enforcement authorities.

11. Intellectual Property

All logos, software, graphics, trademarks, and Platform content belong to SocialSpikes or its licensors.

Users retain ownership of their uploaded content while granting SocialSpikes a limited license to use, display, and distribute it solely for operating campaigns.

12. Third-Party Platforms

SocialSpikes integrates with third-party social media platforms including but not limited to:

• Facebook
• Instagram
• LinkedIn
• X (Twitter)
• YouTube
• TikTok

Users must comply with each platform's terms of service.

SocialSpikes is not affiliated with or endorsed by these platforms unless expressly stated.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy.

By using SocialSpikes, you consent to the collection and processing of your information in accordance with our Privacy Policy.

14. Limitation of Liability

SocialSpikes provides services on an "As Is" and "As Available" basis.

We do not guarantee:

• Continuous availability.
• Guaranteed earnings.
• Guaranteed campaign success.
• Guaranteed engagement.
• Uninterrupted service.
• Error-free operation.

To the maximum extent permitted by law, SocialSpikes shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform.

15. Account Suspension & Termination

SocialSpikes reserves the right to suspend or terminate any account that:

• Violates these Terms.
• Engages in fraudulent activity.
• Misuses rewards.
• Attempts to manipulate campaigns.
• Harms other users or the Platform.
• Fails KYC verification.
• Breaches applicable laws.

Termination may occur without prior notice.

16. Changes to These Terms

SocialSpikes may update these Terms & Conditions at any time.

Updated Terms become effective immediately upon publication.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
